No, the police cannot refuse to take your complaint merely because you do not have the purchase bill of the mobile phone. Absence of a bill does not take away your right to lodge a complaint, especially if the phone has been lost, stolen, or misused. You can provide alternative details such as the IMEI number, box of the phone, warranty card, bank transaction proof, or any other supporting document to establish ownership. The police are duty-bound to register your complaint if a cognizable offence is disclosed. Filing a proper legal police complaint will protect your rights, create official record of the incident, and prevent misuse of the device. If the police refuse to register your complaint, you may escalate the matter to the senior police officer or approach the Magistrate under Section 156(3) CrPC for appropriate directions.
