1. *Verify in Court:* Check from the Court Ahlmad/Registry whether any official summons has actually been issued and dispatched through process server in that private complaint. Take certified copy of order sheet. 2. *Inform the Court:* File an application before the same Magistrate under Sec. 379 BNSS (Old 340 CrPC) with copy of the fake email along with its full header. State that complainant has created a fake email ID in the name of Court and forged court stamp/seal to impersonate the judiciary. Pray for inquiry and for filing a criminal complaint against him. 3. *Police Complaint:* It attracts offences under BNS Sec. 204, 205, 336, 340 for impersonation, forgery and IT Act Sec. 66C, 66D for identity theft and cheating by impersonation using computer resource. File complaint to SHO and Cyber Cell. Preserve the email as evidence. The false complaint is liable to be dismissed and complainant is liable for prosecution and contempt of Court.

For this you need to show the exact email received by you along with all the attachments. After that only I can guide you apropos further course of action. Because what Id has been used by him and has he forged the court stamp, has to be looked at. And if it true stamp, then the course of action will be different. Therefore without seeing email and attachments, there is no perfect opinion.

If the person has created a fake email account to impersonate Court and has sent to summons, then you should approach Police Officials and file a complaint against such person. In addition you may also inform the Court of such act carried out by the Complainant.

Dear Sir/Madam, if the complainant has actually created a fake email account impersonating the Court and sent you a fabricated document purporting to be a court summons/order, this should be treated seriously. You should immediately preserve the original email, complete email headers, sender address, attachments, metadata and the original message without deleting, forwarding it repeatedly, editing it or altering the electronic evidence. You may bring the matter to the notice of the concerned Court and the police/cyber-crime authorities, particularly if there is material showing that the complainant himself created or controlled the fake account. However, before making a formal allegation that a particular person created the account, it is advisable to preserve the evidence and obtain appropriate legal advice, because the allegation should be supported by verifiable electronic evidence rather than merely suspicion. You should also place the genuine case status before your advocate/court and make it clear that no such purported summons/order was received through the official court process, if that is factually correct. The Court can then consider whether an inquiry or appropriate action is warranted. Do not communicate threats or confront the complainant personally about the fake account.
