Settlement with accused and quashing of FIR

We are victim in Delhi. Incident : Snatching of cash of Rs 5.25 bag by thieves in June 2025. FIR registered with section 304(2) , 303(5). 4 accused arrested and the assets are seized. Accused are willing to settle the case without trial and release our assets to us and we also do not want to continue the same. Please suggest what would be the best practice and if any advocate from delhi region can conclude this matter then please reply with suggestion and also contact me.

You can seek quashing of the case from the Hon’ble Delhi High Court. Quashing of FIR because the above mentioned charges are not compoundable in nature therefore it is the only remedy for you. You can anytime file an application before the trial court that you don't wish to continue the case and then the file will be closed. As far as the FIR is concerned it will be quashed by the High Court only in which the true typed and true translated copies of the documents will be annexed. The offences under Sections 304(2) and 303(5) IPC are non-compoundable and serious in nature, so a case cannot be legally settled outside court. However, if you wish to recover your seized cash/assets, you may file an application before the trial court under Section 451 or 457 CrPC for release of property during pendency of the case. Once the trial concludes, the court can order return of property based on evidence. You should avoid any informal settlement, as it may attract legal consequences. Dear Sir/Ma’am If you do not wish to continue the case any further then you can go for the settlement and get the Case compounded or quashed from the Court. However in most of the case having similar scenario quashing is a more suitable option.
