Based on the facts stated, the court has referred the matter for mediation only to explore the possibility of settlement. Mediation does not mean the wife is compelled to compromise or withdraw the case. She may participate in mediation through counsel and clearly place her concerns, including the husband’s drug addiction and past conduct. If no safe and lawful settlement is possible, she has full right to refuse compromise. In such case, the mediation will fail and the main criminal/matrimonial case will continue on merits. There is no legal compulsion to personally talk or reconcile if she is unwilling or feels unsafe.
