Hello, In this case, we first need to know the exact charges made against you. The trial will then proceed accordingly, and based on the evidence presented, you may be acquitted if no offence is proved.

Your matter pertains to appearing as a proxy or dummy candidate in an examination, which is a serious offence involving cheating and impersonation. Such an act attracts penal provisions under the Indian Penal Code and related examination laws, as it amounts to using dishonest means to secure an undue advantage. Since you were apprehended by the police during the occurrence, the case will primarily depend upon the evidence collected during the investigation, including witness statements, examination records, and any documentary or digital proof linking you to the offence. You Engage an experienced criminal lawyer who can examine the FIR, evidence, and legal provisions to prepare an appropriate defence strategy. If there is no prior criminal record and you are a student or first-time offender, the court may consider granting you the benefit of probation or a lesser sentence depending on the circumstances and nature of the evidence. Hence, your case’s outcome entirely depends on the police investigation and the evidence produced before the court. A sincere and cooperative approach during the inquiry and trial will be beneficial for securing a lenient and favourable outcome in the near future.

I understand how worried you must be, but please remember that what has happened is serious — impersonation in an examination is treated as a criminal offence under Indian law. However, there are still legal remedies and possibilities depending on how the case is handled. First, the act of appearing in an exam on behalf of someone else can attract provisions under: Sections 419 and 420 of the Indian Penal Code (IPC) – for cheating and impersonation, and Possibly under provisions of the Information Technology Act if electronic systems were involved. That said, the judge does not acquit merely on “future prospects”, but the court can take a lenient view if you are a first-time offender, a student, and there was no criminal intent to cause financial or long-term harm. The courts in India have repeatedly recognized the importance of giving a chance to reform, especially to young individuals.
