As for the Juvenile in question, according to the Section 6(1) of Juvenile Justice Act, (Care and Protection of Children), 2015, Any person who has completed 18 years of age, and is apprehended for committing an offence when he was below the age of 18 years, then such person shall, subject to the provisions of this section, be treated as a child during the process of inquiry. Thus, that juvenile will be tried according to the rules of Juvenile Justice Board. For that what you have to do is, get a FIR registered in his name in the nearest police station having jurisdiction over that area where the offence was committed, and then go on with the proceedings in the Juvenile Court.
