Procedure to withdraw a complaint
16-Dec-2023 (In Criminal Law)
I had registered an online complaint in NCW which is still under scrutiny. But the matter has Bern mutually resolved and i hv been adequately compensated. Hence i wish to take down the complaint. What is the procedure for the same ??
Hi,
Unless the complaint is about a serious crime or the crime is against the society, you can withdraw it. NCW tackles the complaints in either of the following methods:
1) Investigations by the police are expedited and monitored.
2) Family disputes are resolved or compromised through counseling.
3) For serious crimes, the Commission constitutes an Inquiry Committee which makes spot enquiries, examines various witnesses, collects evidence and submits the report with recommendations. Such investigations help in providing immediate relief and justice to the victims of violence and atrocities. The implementation of the report is monitored by the NCW. There is a provision for having experts/lawyers on these committees.
If your complaint falls in one of the first two categories, you can send a written request for withdrawal of the complaint by Registered post with acknowledgment due and keep the copies.
