Procedure to file complaint if person has acquired government property

Hi in our land one neighbour constructed 6feet of road with out documentation and registration and that guy occupied 10 feet of Govt land showing as our land road to walk as no one has rights to enter in our property with out registration can we file criminal case on this person as he is illegally occupied our land and constructed road causing physical damage what is procedure of it
