Statutory Remedies for Public Nuisance (BNSS, 2023) Section 152 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) (formerly Section 133 of the Cr.P.C.): You can move an application before the Executive Magistrate / Sub-Divisional Magistrate having jurisdiction. The provision empowers the magistrate to issue a conditional order for the removal, restriction, or regulation of any trade, occupation, or running of any machine (such as powerlooms) that is injurious to the health or physical comfort of the community. 2. Environmental & Noise Pollution Norms (TNPCB) The Noise Pollution (Regulation and Control) Rules, 2000: Residential areas have strict permissible ambient noise limits (50 ext{ dB(A)} during day time and 40 ext{ dB(A)} during night time). Operating multiple powerlooms with only a single GI sheet provides negligible acoustic insulation, almost certainly breaching these limits. Tamil Nadu Pollution Control Board (TNPCB): Industrial/manufacturing units like powerlooms require Consent to Establish (CTE) and Consent to Operate (CTO) from the TNPCB, alongside mandatory installation of acoustic enclosures and sound-damping measures. A formal representation/complaint can be lodged with the District Environmental Engineer (DEE) of the TNPCB to inspect the premises for noise pollution and lack of statutory clearances. 3. Local Authority & Planning Violations Trade License and Zoning Regulations: Powerlooms operating in residential zones generally violate the local Master Plan or Development Control Regulations (DCR) enforced by the Directorate of Town and Country Planning (DTCP) or the local Municipal Corporation / Panchayat. Approach the local Commissioner, Executive Officer, or Panchayat President pointing out the lack of commercial/industrial classification for the site and absence of a valid trade license. 4. Civil Remedies (Injunction & Damages) Suit for Private Nuisance: File a civil suit for permanent and mandatory injunction under the Specific Relief Act, 1963, seeking to restrain the operators from running the powerlooms without adequate sound-proofing or compelling them to relocate, alongside claims for damages for loss of peaceful enjoyment of property.
