09-Feb-2023 (In Criminal Law)
My brother is already in jail. Police took my father for investigation and are not releasing him. If a person is arrested by police for investigation. For how long they can keep the person in the police custody? What articles are violated?

If police has detain some person for inquiry, he has to be produce before the court within 24 hrs, police can't detain any person more than 24 hrs without taking his remand from the court. In your case what you can do is file a bail application before the court, the court will call for report from the concerned police station, if in the report it is found that there is some charge against your father the court will decide your bail application and if police send a report that there is no charge against your father then police has to release him, if they don't do so then file habeas corpus writ petition before high Court you will get the relief.
