Need legal help for my son who fled from home with his ex teacher.

10-Mar-2026 (In Criminal Law)
My son was 16 when I first saw his text with his ex school teacher who was a lady. At that time I made him delete his social accounts and I too deleted all the chats. Now my son is 21 years old and he fled from home with the same teacher and told us that he did temple marriage with her. Before leaving home he mailed the local PS, commissioner, CM and PM that we are opposing his will to live with the lady. How can I bring my son back home? What are the legal actions I can take against the teacher?

Since your son is now 21 years old, he is legally a major under Indian law and has the right to make his own decisions regarding marriage and where he wants to live. If he has voluntarily left home and married the lady by his own consent, generally no criminal action can be taken against the woman merely on that ground. However, if you believe that he has been influenced, coerced, or wrongfully confined, you may approach the local police and request them to verify his safety and statement. You may also file a petition before the Hon’ble High Court seeking appropriate directions to ensure that your son appears before the court so that his statement can be recorded regarding whether he is staying with the lady out of his free will. If there was any inappropriate relationship when your son was a minor and you have evidence regarding the same, that aspect can also be examined legally. The exact legal remedy would depend upon the facts and available evidence, therefore the matter needs proper legal evaluation.

File a General Diary / Missing Diary at the police station stating: teacher had earlier relationship when he was minor you suspect grooming since school days Step 2 File a detailed complaint invoking POCSO regarding the period when he was 16. Step 3 Send a representation to the education department about unethical teacher-student relationship. Step 4 If you suspect manipulation or exploitation, police can record your son's statement.

Since your son is now 21 years old and an adult, he has the legal right to choose where to live and whom to marry. Therefore, it is generally not possible to legally force him to return home if he left voluntarily. However, if there is evidence that the teacher had an inappropriate or exploitative relationship with him when he was a minor (16 years old), you may consider filing a complaint with the police regarding those earlier incidents. Such action would depend on available evidence and specific facts. It would be advisable to consult a qualified lawyer to review the situation and guide you on the appropriate legal steps.
