Mental torture and harassment by professor

10-Jan-2023 (In Criminal Law)
I am an engineering student currently in my final semester. I recently faced mental harassment by professor who denigrated me and fabricated lies to spoil my grades. The professor is spreading false allegations against me to deprive me of my deserved grades. He even went to the extent of threatening me, saying, "we could have failed you."

Due to this, I have been feeling mentally harassed, experiencing sleepless nights, nightmares, and extreme distress. I feel worthless and deeply affected. Is there any law against mental harassment by teacher, and is it worth fighting against such corrupt individuals?

Absolutely. No one, including a professor, has the right to mentally harass a student. There are laws against mental harassment by teachers in India, and legal action can be taken if necessary.

The first step should be to address the issue at the college or university level. You can file a formal complaint against a teacher for mental harassment with the Head of Department (HOD), Principal, or College Administration. Most educational institutions have grievance redressal mechanisms to handle such cases.

If the institution fails to take action and the mental harassment in college continues, you have the right to escalate the matter legally. You can file a written complaint with the police under relevant sections of the Indian Penal Code (IPC), such as:
  • Section 506 IPC (Criminal Intimidation): If the professor is making threats.
  • Section 500 IPC (Defamation): If false allegations are being made against you.
  • UGC Regulations on Prohibition of Harassment: If your college is affiliated with UGC, they are obligated to address complaints related to mental harassment by teachers in India.
If you are facing severe mental distress, you may also seek legal remedies for psychological harm caused due to harassment.

If you wish to proceed further, you can consult a lawyer to explore your legal options and take necessary steps to protect your rights. Let me know how you’d like to proceed.
