Limitation period for filing a case for sexual harassment

30-Aug-2023 (In Criminal Law)
I made my complaint personally handed over to police on 19-5-2018. My case is regarding 'sexual harassment as a minor'. Till now they have not lodged a FIR. They are saying the case is 'too old'! What to do?

Hi, there is no limitation for filing a case for sexual harassment. If they are not registering your FIR, you can write a letter about the same to the SP of your area. Alternately you can file a case in metropolitan court under section 156(3) CRPC for registering your FIR.

There is no limitation to file the case for sexual harassment. If police is not lodging fir, go to woman's helpline or give an application to the SSP of your area. If they say that it is very old you can tell them that police has not taken any action. If noone cooperates, go to advocate, he will give your application to magistrate.

There is no period of limitation as per a complaint of sexual harassment. If the police is not accepting the same you can send in a letter to the SSP along with a copy of the same to the relevant police station. If no action is taken then also, you can approach the concerned Judicial Magistrate of your area and file a complaint under Section 156(3) of the Criminal Procedure Code.

You have made my complaint personally handed over it to police on 19-5-2018 but they did have not lodged FIR. Now you have to make a report to the SSP thereafter you have other option to file application be Chief Judicial Magistrate.
