Is Ecourt record correction automatic?

22-Sep-2025 (In Criminal Law)
Hi, There is a public ecourt record under my name which has a small spacing error in the respondent name. So what happens with these errors: 1. Does court automatically correct these mistakes in review? 2. I need to ask for the correction, otherwise no change happens to the record? What is the procedure

Hello, Clerical errors are generally not given much weight, as they do not affect the rights or liabilities of the parties. Therefore, it is not always necessary to correct them. However, if you still wish to have the error rectified, you may request your counsel to bring it to the court’s attention so that the correction can be made.

Minor spelling/spacing errors in eCourt records are not corrected automatically. They remain as it is unless a party moves an application. You can file a simple application for correction/rectification before the concerned Court under Section 362 CrPC read with inherent powers of the Court. Once allowed, the order is communicated to the court staff and the eCourt record is updated. If the mistake is clerical/typographical, correction is generally permitted without affecting the case.

Court normally does not make automatic correction in name spelling or spacing mistakes. If there is any error in your name or respondent’s name in the order-sheet or ecourt record, you have to move a simple application before the concerned court under Section 362 CrPC read with Section 151 CPC for clerical/typographical correction. Court on perusal will pass order to correct the record. Such corrections are routine in practice and no prejudice is caused in main case. It is advisable to file an application mentioning correct name with supporting ID proof, so that future certified copies and record show the proper name.
