Is appearing on the first date of hearing compulsory?
28-Sep-2023 (In Criminal Law)
I have filed a criminal case against my nri husband , and I have got first date from court but I will be out of time as per pre schedule event, so I told my lawyer about the same and lawyer says me that my presence is not compulsory and I can go out on that date. please tell me how true is it!
Your lawyer can take the next date from the Hon’ble court as you are not able to be present in the court on the said fixed date, at max you may be fined for a meagre amount and the next date will be allotted to you. Also, your lawyer can also plead in your absence if your presence is not required by the court. you will have to file an exemption application. but its advisable to appear in the court.
