Intentional police loud siren at night
09-Jun-2025 (In Criminal Law)
serious concern regarding frequent and unnecessary use of police sirens in my area during late-night hours intentionally. These sirens are often used without any visible emergency and have been causing constant disturbance to my sleep, affecting my health and well-being. What should i do? Can i file criminal case for this intentional disturbance? Can i file civil case?
you can file criminal case of public nuisances created by police. at late night , siren continues cause noise . which further cause sleep disorders/disturbance. You may also write at public grievance portal. if , there is medical proof of your mental well-being disturbance. then you can also file civil suit (tort) for compensation.
If sirens are being misused regularly without visible emergencies and are affecting your health, you can file a formal complaint with the local police commissioner or DCP in writing. You may also approach the State Human Rights Commission citing violation of your right to peaceful sleep and mental well-being. Filing a criminal case may not be directly applicable unless there's proof of deliberate harassment, but a civil case for nuisance under tort law is possible if the disturbance is continuous and avoidable.
