In the pending petition under Section 319 CrPC (now Section 358 BNSS), the court is considering whether additional persons should be summoned as accused in the ongoing criminal case before the MM Court. Since the respondents/proposed accused have already filed their counter statement, the matter has now reached the stage where the petitioner must argue and respond to that counter. The court’s observation means that the petitioner’s side will now explain why the objections raised by the respondents are incorrect in law or facts and why sufficient material exists to summon them as additional accused. A counter statement containing “mere denial” means the respondents have only denied allegations without producing convincing evidence or strong legal grounds. “Misinterpretation of law” means the petitioner believes the respondents have wrongly relied upon or incorrectly explained legal provisions and judgments to oppose the application. At the Section 319 stage, the court mainly examines whether evidence already recorded during trial discloses a strong prima facie case against the proposed accused; detailed defence evidence is generally not appreciated at this stage. Therefore, postponement of hearing does not mean rejection of the petition. It only means that the enquiry/hearing on the petitioner’s arguments has been adjourned to another date. On the next date, the petitioner’s counsel will likely argue that the evidence already available in the trial is sufficient for summoning the proposed accused and that the counter filed by them does not legally weaken the application.
