in a CC private complaint case pending 6 years without disposal, an application under Section 319 CrPC has been pending for about 6 months without adjudication. Can we rely on Section 309 CrPC and the right to speedy trial to request the court to dispose of the 319 application to avoid further adjournments

Yes you can rice such a request before the court. Section 309 CrPC requires to proceed with the trial as expeditiously as possible and avoid unnecessary adjournments. If an application under section 319 CRPC is pending for a long time it can delay the process of the case . You may request the court decide the section 319 application at the earliest so that the trial can proceed without any further delay , the right to speedy trial which is part of article 21 of the constitution and also be relied upon to seek early disposal. Your advocate can file or make an oral request before the court seeking early adjudication after pending application.
