Under Section 117(2) of the Bharatiya Nyaya Sanhita (earlier corresponding provisions under IPC relating to voluntarily causing grievous hurt), the filing of the charge-sheet is governed by Section 173 Cr.P.C. (now Section 193 BNSS). Bail granted to the accused does not automatically mean that the charge-sheet has been filed; bail can be granted during investigation as well. To ascertain whether the charge-sheet has been submitted, you may adopt the following course: Visit the concerned Illaqa Magistrate Court and inspect the judicial file through your counsel. Once the charge-sheet is filed, the case status will reflect “Challan presented” or “Police report under Section 173 filed.” Check the e-Courts portal by entering FIR number, party name, or case number; if the charge-sheet is filed, the next date will usually be for consideration of documents/supply under Section 207 Cr.P.C. You may also move a simple application before the Trial Court seeking status of investigation. Alternatively, obtain information from the Investigating Officer. Kindly note, if the offence carries punishment up to 10 years, the statutory period for filing charge-sheet is 60 or 90 days depending upon the maximum sentence prescribed. If not filed within the prescribed period, the accused may claim default bail. For precise advice, the FIR details and stage of proceedings must be examined.

You can go to the relevant court with the FIR number and ask the reader what stage is rhe case in or check online for the same. Or you can call the investigating officer and ask for whether charge sheet has been filed.

To know whether the charge sheet has been filed in a Section 117(2) BNS case, you can check the case status at the concerned Magistrate court by giving the FIR number and police station name, or search the case online on the e-Courts portal using the FIR number or accused name; once filed, the status will show “charge sheet filed” or the next date for appearance/supply of documents, and remember that the accused getting bail does not automatically mean the charge sheet has been submitted.
