If the Family Court has already passed an order granting maintenance and the opposite party is still not paying, filing an execution petition is the correct first step. During the execution proceedings, the court can take coercive measures to recover the arrears, including attachment of the defaulter's salary or property, and in appropriate cases, imprisonment for willful default, depending on the applicable law and the facts of the case. If the execution petition has already been filed but there is no progress, we can request the court to expedite the execution proceedings, seek attachment of the respondent's assets or salary, and press for appropriate coercive action. Please share the date of the maintenance order, the amount awarded, and under which provision the order was passed (e.g., Section 125 CrPC/Section 144 BNSS, the , or the ), so I can advise you on the most effective next step.
