How long does a 498A case proceed? Within how many dates can the case be closed? What should be the period between two dates? Can the case be elevated to Fast Track Court if the above answers are not satisfactory? If I apply for u/s 205 of Cr.P.C., can I get it for me and my elderly parents? Will it be helpful?

  • A> Maintenance and DV cases are running, paying 5k per month (Other Court).
  • B> Since I lost my job when OP filed 498A three years ago in June '11, and no one provides a payroll job since my cases are not yet fixed, I roam around for living and part-time jobs/freelancing.
  • C> Now I would really like to expedite the process as my savings are nearly exhausted.
  • D> I am already 34 years old; more delay in the process will affect my future.

No, only sessions triable cases are tried in Fast Track Court. Your case, being a Warrant Case, will be tried in a Magistrate Court only. If you apply for u/s 205 of Cr.P.C., it helps only by waiving your personal presence in court but does not necessarily speed up the trial.

If you wish to expedite the case, an appropriate application can be filed in High Court, Calcutta, to seek an order for a time-bound trial, generally within 9-12 months.
