I had a dui registered under 185 bns on 31st august , first time offense and definitely last , wanted the case disposed of as dont want it showing against my record (i didnt know that it will show on record ) the police station also doesnt want to pursue case but are doing it as its registered online in the portal , The BAC was 51mg where the limit is 30 mg . the police station has so far not filed anything , needed help in knowing how to get the case disposed of without it going on my record .

Since your BAC was 51 mg/100 ml against the 30 mg legal limit, Section 185 can apply, even though this is your first offence. If the police have not yet filed the challan/report, consult a local traffic/criminal advocate immediately to check the case status and documents and explore the available lawful remedy before the Magistrate. Do not rely on the police saying they do not want to pursue it, and note that a first offence does not automatically mean the matter will disappear from the record.

Did a brief red light or a led light Flash after you blew into the breath analyser? Because only then it “registers” into the system.. if it’s in their system then it’s generally registered under bailable offences and can get you bail there and then and you’ll have to pay the fine at the police station…
