Gave experience letter to an employee now case filed against him

A operator was working with us left the job, and since he said he is getting a better job issued him a experience letter of his work and had written all good things about him, we later came to know that he has filed a criminal case u/s 323 and 504 of i.p.c, now can this experience letter issued by us in good faith be used to show in court that had we beaten up this person and threatened him to kill, why should we have given him experience letter and write all good things about him, he has already filed this letter in court as proof of service, which we never denied.

No, it was only an hour experience certificate and not a character certificate. Moreover, it was made on the basis of his performance at work and the details supplied by him to you, hence it can't be inferred that you knew about the pending case. Also, it is a mere piece of paper which in the eyes of law holds no relevance.

This is typical case of the liability of the master and the agent as the operator is working as an employee or an agent where any act done by an agent in the service of the master , agents acts and liability is also liability of the master, as the operator no longer works with the organization and act committed by him will be independent and the organization is not liable for any of his action even if you have issued good service certificate hence you dont have to worry at all, kindly engage a lawyer to handle you case
