28-Aug-2025 (In Criminal Law)
there is a fraud in my credit card amounts to 95000/- and Saving Bank amount to Rs. 5000/-.

You have already taken the correct first step by lodging a complaint with the Cyber Crime Cell and informing the Bank. Now, as per RBI guidelines on electronic banking transactions , if you report an unauthorised transaction within 3 working days, you have zero liability and the bank must refund the amount to your account within 10 working days. Since you have the cyber-crime acknowledgement and have intimated the bank, you should immediately: 1. Submit a written dispute claim with your bank’s card division and branch, enclosing the Cyber Crime complaint copy and acknowledgment, specifically invoking the RBI “zero liability” rule. Demand reversal of the fraudulent debit. - 2. Escalate to the Bank’s Nodal Officer/Head Office if the branch does not respond within 7 working days. - 3. If the bank still does not reverse the transaction, file a formal complaint with the RBI Integrated Ombudsman Scheme, 2021 (online complaint portal). RBI has been very strict with banks in such matters, and banks are bound to credit the disputed amount if you reported it on time. - 4. Since the fraudster parked the money with Swiggy Limited, share all transaction details with Cyber Crime so they can freeze the beneficiary wallet/account and track the end-user. 5. Keep all documentation — emails, SMS alerts, complaint numbers, acknowledgement copies — as evidence. This will protect you if the bank resists refund. Also email swiggy about the same and requesting the money back - keeping MCA , CYBER CELL, DCP POLICE, SFIO, YOUR BANK, RBI in CC
Because you reported the fraud on time, the law is on your side. As per RBI rules, the bank has to refund you. Your job now is just to keep everything in writing, keep following up, and if the bank delays, escalate to RBI Ombudsman. At the same time, Cyber Crime Cell will investigate the fraudster
Kindly report to the RBI under the banking ombudsman scheme. I can apply for you if you want my services. Kindly provide all documentation for the same. Further legal proceedings can be initiated after this if required.
