13-Jul-2023 (In Criminal Law)
Hi, I filed an FIR on my uncle when he physically fought with me and my dad. The charge sheet is yet to be filed by the police. Recently I am planing to travel abroad to persue my MS. Can I leave the country if the case is still on.

You have to inform to police before leaving, all ur statements and other procedure would have to be completed, otherwise police will not (may be) file chargesheet to court. Or they will not file it to court, saying for incomplete investigation and unavailability of complainant.

Yes, you can travel abroad. Once the FIR is filed, it is the responsibility of the Police to file the charge sheet within the stipulated period of 90 days. After the charge sheet is lodged with the court, the trial will commence.

Dear client as u r the complainant. If u go abroad during the trial of case then it will be beneficial for yr uncle. Because of yr non presence court will dismiss yr case and yr uncle will get acquitted. For any legal help call me
