Death certificate refusal by Panchayat secretary and false RTI reply

21-Feb-2026 (In Criminal Law)
My grandmother Late Chandrawati Devi died on 05 Jan 2018. Jeetpur Panchayat Secretary refused to process death certificate saying Aadhaar and Voter ID are compulsory, which is not required under Registration of Births and Deaths Act 1969. Deceased Aadhaar and Voter ID not available but original Indian Railways pension book is available. In RTI PRACD R 2025 60099 false reply was given. Need legal advice against Secretary and BDO.

Aapka case Registration of Births and Deaths Act, 1969 ke tahat aata hai. Death certificate jari karne ke liye Aadhaar ya Voter ID compulsory nahi hai. Yadi Panchayat Secretary bina kanooni aadhar ke mana kar rahe hain, to yeh galat hai. Aap sabse pehle Block Development Officer (BDO) aur District Registrar (Birth & Death) ko written complaint dijiye aur receiving le lijiye. Agar phir bhi certificate issue nahi hota, to aap SDM/District Magistrate ke samne complaint ya writ petition High Court me file kar sakte hain direction ke liye. RTI me galat jankari dene par State Information Commission me appeal bhi ki ja sakti hai. Pension book aur anya documents proof ke roop me diye ja sakte hain.
