criminal case cc case magistrate court

in a CC private complaint case pending 6 years without disposal, an application under Section 319 CrPC has been pending for about 6 months without adjudication. Can we rely on Section 309 CrPC and the right to speedy trial to request the court to dispose of the 319 application to avoid further adjournments

A CC Case (Calendar Case) is a criminal case that is taken on the Magistrate court file after the police file a charge sheet. Process: FIR is registered by police. Police investigate the case. Police file a Charge Sheet under Code of Criminal Procedure, 1973. The Magistrate takes cognizance of the offence. The case is registered as C.C. No. (Calendar Case Number).
