Countercase against BNS 85, 351, 352, 115,

15-Aug-2026 (In Criminal Law)
Hi, has it it ever possible that a countercase be filed against the BNS85 case. I've secured anticipatory bail, and now beginning of the trial. We know that allegations in the FIR were vague.

Yes, a counter-complaint/case can be filed, but it should be based on specific acts and evidence (e.g., false allegations, threats, assault, defamation, etc.), not merely because the BNS 85 case is vague. Since you are already on anticipatory bail and trial is beginning, it is usually better to focus on your defence and preserve all evidence of contradictions/vagueness, while separately considering quashing or other remedies where legally available. Courts have recently reiterated that Section 85 requires specific ingredients of cruelty/harassment and that vague allegations may be insufficient.

Yes, a counter-case may be possible, but it depends on the facts and the specific offences alleged in the BNS case. A vague FIR by itself does not automatically justify a counter-case. If the complaint contains false allegations, fabrication, assault, threats, or other cognizable offences committed by the complainant side, an independent complaint/FIR can be considered. Since you have already obtained anticipatory bail and the trial is commencing, it is important to preserve all evidence, contradictions and documents showing falsity. The proposed counter-case should be filed only after carefully examining the FIR, statements, medical records and available evidence.

Firstly make sure you get your name completely removed from this case.. that is of utmost importance.. the rest can be taken care of later on.. Counter FIR is almost a myth and specially if it’s a woman on the other side.. for more details I shall get in Touch with you
