Convert NCR to FIR for insurance purpose
22-Jan-2025 (In Criminal Law)
Forgot my bag in auto. Tracked auto in 4 hr but driver said he does not remember which passenger took bag. Police filed NCR. Insurance company wants FIR copy for processing claim. CCTV footage shows I left bag in auto. Can auto driver file FIR on my behalf as bag was stopen from his auto? Can NCR be converted to FIR?
I understand your concern. Here’s how you can proceed:
Conversion of NCR to FIR: Yes, an NCR (Non-Cognizable Report) can be converted to an FIR if the nature of the offense falls under a cognizable offense, such as theft. You should approach the police station with the CCTV footage and request them to convert the NCR into an FIR. Highlight that the bag was stolen, which is a cognizable offense under Section 379 of the IPC (Indian Penal Code).
Auto Driver's Role: The auto driver cannot file the FIR on your behalf, as you are the aggrieved party. However, he can provide a statement to the police supporting your claim.
Insurance Claim: The FIR is crucial for your insurance claim. If the police initially hesitate to register the FIR, you can escalate the matter to a higher officer, such as the Superintendent of Police, or file a complaint with the Magistrate under Section 156(3) of the CrPC, requesting the registration of an FIR.
Ensure you keep all evidence, including the NCR, CCTV footage, and any communication with the auto driver, to strengthen your case. Let me know if you need assistance drafting a formal complaint or representation to the police.
Would you like help preparing any documents for this?
