cheated by a Foreign national in Bangalore

I wanted a mobile application to start an online business. I came across an Armenian National, staying in Bangalore, having a private limited company registered in India. He promised me the mobile application for 6000$. I paid him the money and he took all design details from me. Abruptly, he told me that he would not finish the work and neither would repay me back. He asked me to file a civil suit against him. One day he told that he sold my idea, design and code to some third parties in India and abroad. He also shut his office, but as per MCA website, address has not changed. what to do?

As I am cyber crime specialist, I understand your issue. There are many issues like this are happening in Bangalore.

I need to understand couple of things here, Did you approach registered company / is there any contract is been made for this software delivery / The money paid to him in USD or INR .. etc.,

If the company is been registered you can file civil suit against them else you may need to file criminal complaint u/s 420,467,468 IPC and Information Technology act. you may need to approach Cyber crime police(High Grounds) for this.

From your query, is it unclear if you had entered into an Agreement with the Armenian National for making the mobile application for you. If you have set out the terms and conditions in the Agreement, it will help build your case. If not, please collect all other documents that may help you. When you paid him the money, did you obtain a receipt? Do you have any bank documents (NEFT/ RTGS etc.)? All the communication that you have exchanged with him - SMS, e-mails, whatsapp etc. – please collect it and approach a lawyer. Even electronic documents can be used in Court. You can also try to file a complaint or a criminal case for fraud, cheating etc. However, you may need the materials to build the case for effective trial. You can also try to send a Legal Notice and see if he will respond to it.
