Since you accused your brother and his wife of theft without proof, he can pursue a defamation case under Section 500 IPC. You may defend on grounds of misunderstanding and lack of malice, but it is better to explore settlement or compromise to avoid prolonged litigation.

As the case pertains to defamation, your brother cannot win it. the word publication is a must here and since there is no publication the chances of your brother winning the case is almost negligible. you need a strong advocate to prove the word

From the facts you shared, this matter involves allegations of theft made in writing against your brother and his wife, followed by his private complaint for defamation. In law, for a defamation case to succeed under Sections 499–500 IPC (now Sections 354–357 of BNS), the complainant must prove that false and defamatory statements were published with intention to harm reputation. Your admission that you accused without evidence and in anger could technically support his claim. However, you may have valid legal defences: Exception of Good Faith / Public Interest: If your letter was written in good faith, out of a genuine but mistaken belief regarding missing property, this can be argued as lack of malicious intent. Limitation: Defamation complaints usually have to be filed within one year of the alleged offence (Sec. 468 CrPC/BNSS equivalent). Since he is raising it after 7 years, the court may consider it time-barred unless special reasons are shown. Arbitration Proposal: Arbitration is not the usual remedy in criminal defamation. If he wants to arbitrate now, it indicates he may not be confident in pursuing criminal prosecution. Thus, while technically he can try to press the defamation claim, his chances of success are weak after 7 years due to limitation. You should contest on grounds of limitation and absence of malice. At most, the matter may end in compromise or apology, but conviction is unlikely.

Private letters may not qualify as a defamation material. The stage of the your matter and correct arguments put to the court may exonerate you completely. You have to be mindful on how you pitch your case.

Yes, your brother can pursue a defamation case because you made written allegations of theft without evidence. In defamation, the burden will be on him to prove that your accusations harmed his reputation. Since you admit you do not have proof of stealing, the defence becomes weaker. However, you can argue that the letters were written in anger, were private communications, and not intended for public circulation, which may reduce liability. Arbitration may help in settling the matter without prolonged litigation.
