Can I file 420 case against company officials after 3 years

Can I file 420 case after 3 years against company officials, for not clearing off my funds, even when company claims to have paid it ( has paid tax on amount to be given already to the government).

Did you enter into an employment contract with your employer? If yes, then do share the details because it would contain a clause regarding resignation and payment of salary in lieu of notice period. If not, then you should immediately send a legal notice to your employer and demand payment of your dues and if your company then fails to pay then you can approach the appropriate labour court for redressal. Also attach an application for condonation of delay.

Yes a criminal case can still be filed. It is not ruled by the law of limitation. You should have enough documents to prove your case. All your ITR of the year you are claiming. The documents provided by the company also send a legal notice to them just in case they want to settle the matter out of court.
