Since the girl is admittedly 15 years old, she is a minor under the POCSO Act. Even if she initiated the interaction or appeared older, that is not a legal defence if any sexual act or sexual communication with a minor is alleged. From the facts stated, if your brother only exchanged a handwritten note containing his phone number and asked about her feelings, and there was no physical contact, sexual conversation, meeting in private, or exchange of obscene material, that alone does not automatically constitute a POCSO offence. However, the risk of a complaint cannot be ruled out. If an FIR is lodged, your brother should immediately consult a criminal lawyer, cooperate with the investigation, preserve the original note and any other evidence, and avoid any direct or indirect contact with the girl or her family. Do not attempt any compromise or communication that may worsen the situation. The exact legal position will depend on the contents of the note and the allegations made in the complaint.

Dear Client, since the girl is stated to be 15 years old, she is a minor in the eyes of law. Under the POCSO Act, the age of the child is the primary consideration, and consent or initiation by the minor is generally not a legal defence. However, based on the facts shared by you, if the incident was limited to exchange of a note containing phone numbers and there was no physical contact, sexual act, obscene communication or harassment, the exact legal consequences would depend upon the contents of the communication and the evidence available. Your brother should immediately stop all contact with the girl and her family, preserve any relevant evidence, and avoid any action that may worsen the situation. If an FIR is lodged or there is a genuine apprehension of one, consult a local criminal lawyer without delay to examine the facts and take appropriate legal remedies, including seeking anticipatory bail, if legally maintainable.

Based on the facts shared, there is no automatic POCSO case merely because your brother exchanged a note or phone number. However, since the girl is stated to be 15 years old, the matter should be treated with utmost seriousness. If no FIR has been registered even after 24 days, it does not necessarily mean one will never be filed. Your brother should immediately stop all contact with the girl and her family and should not attempt to influence or communicate with them. If an FIR is registered, he should promptly consult a criminal lawyer to seek appropriate legal remedies, including anticipatory bail (if legally maintainable under the applicable law) or regular bail, depending on the offences invoked. Preserve all relevant facts and evidence, as the exact legal advice will depend on the contents of the FIR and the allegations made.
