Bike showroom fraud by showroom manager

29-Aug-2025 (In Criminal Law)
I booked a scooter on 2nd July from a Kolkata showroom with delivery promised by early August. I paid ₹80,000 via UPI to the manager’s personal account, who gave me a handwritten receipt with showroom stamp and signature. After 16th August, I learned the manager had passed away. The main showroom confirmed she was their employee but now denies responsibility, refusing delivery or refund, citing payment to a non-official account despite my proof.

Hi, You have different remedies:- 1) You can send a formal legal notice to the showroom demanding either the delivery of the scooter or the full refund within 15 days of the receipt of the notice. 2) File a complaint in Consumer Court claiming refund of Rs 80,000 + interest + legal costs and compensation for mental harassment. 3) File a criminal complaint before the local policestation for Cheating, Criminal breach of trust and fraud
