One of my relative is arrested under fake govt. jobs racket one year ago,and i gave guarantee of Rs 50000 in the form of lien over my two wheelers. Now i come to know that he is absconding and does not appearing in honourable court on Dates. Now i want to know that what can i do,to save my skin. Will i be arrested as i am a guaranter. What would be the worst legal action taken by honourable court against a guaranter in this type of cases. Can i take back my guarantee and remove myself from the case,Kindly suggest me the course of action i must do right now?...Please help!

Yes you can withdraw your guarantee with the permission of the Court.

Your maximum liability is Rs. 50,000/- only if the court demands.

If the recovery is not possible from your assets then you are liable to be arrested. But that is a very remote chance. Ask the accused to be present before the court or take the services of a lawyer who shall assist you in getting back the surety.

Now that the accused is absconding, you can not withdraw your guarantee. To save yourself, you will be liable to pay 50000/-which is the amount of guarantee. Then you can seek permission to withdraw your guarantee.
