Alcohol Abuse and Physically + Verbally Abusive Domestic Help

01-Mar-2026 (In Criminal Law)
We are a family whose domestic help -- a couple and their daughter -- have lived in our quarters for 5 years. The husband has a history of alcohol abuse which has escalated recently. He has become a public nuisance, is verbally and physically abusive towards his wife and daughter. We have asked him to vacate premises but he keeps returning. What are our options for ensuring he does not return? Can we offer any limited help to his wife + daughter?

Hlw, in the above-mentioned situation, you can file an application under sec 144 as well as an eviction suit against the tenant. Yes you can also help them by guiding them in this situation but before taking any step kindly consult an advocate.

I understand your concern, as this situation involves both safety issues and legal complications. From what you have described, the husband’s conduct—especially physical and verbal abuse—can attract serious legal consequences, and immediate steps can be taken to ensure safety and prevent his return. You have the option to approach the police and lodge a complaint regarding nuisance, trespass, and abusive behavior. If he continues to enter the premises despite being asked to vacate, legal action for criminal trespass can be initiated. Additionally, you may also seek assistance from local authorities to ensure he is restrained from entering your property again. At the same time, his wife and daughter are legally protected under domestic violence laws. They can seek protection orders, residence orders, and maintenance under the law, which can legally restrain him from committing further acts of abuse and even bar him from approaching them. You can certainly extend limited help to the wife and daughter by guiding them towards legal remedies or helping them connect with appropriate authorities or support systems, while ensuring your own legal safety is not compromised. I have been handling criminal and domestic dispute matters for the past few years, including cases involving abuse, trespass, and protection orders. I assist clients in taking immediate and effective legal steps to ensure safety and long-term resolution. Such matters require prompt and strategic action to avoid escalation. I can guide you on the most effective course to protect your premises as well as ensure the safety of the affected individuals. You may consult with me to discuss this matter in detail. I will ensure it is handled with proper legal strategy, urgency, and confidentiality.
