ACQUITAL/FIR QUASHING of FIR under IPC 188 case

In a examination, a headphone device (OnePlus bullet Z) unconsciously kept hanging in my neck.I entered exam hall at 10 40. I was sitting in exam hall from then till 12.Exam started at 12. At 12: 10 someone noticed it , & they gave a police complaint & an FIR under sec 188 IPC.My defence point.1. i bought it 2 year ago, ,its normal use headphones device.Not possible to practically cheat with such a big device, it was carried unconsciously and unintentionally.is Acquittal/FIR quashing possible?

You must prepare your strong defence and submit it before the court. Since the FIR has been registered against you then it will only be quashed by the High Court. You need to approach the HC with a quashing petition with all the evidence which you think can benefit you. For more legal assistance I am just a call away.

it would be difficult to get the FIR quashed from the High Court considering that you were caught red handed with a headphone in your ear.

however the charge sheet if filed or the FIR have to be perused to give a conclusive answer

the quashing of FIR is done either at the police station or if the case has been filed then by the high court only. All the defence points can be given to the police with a submission that the FIR should be cancelled , then it is the prerogative of the police how they proceed.
It is better to be in touch with a prudent advocate who can handle such matter
