This is a serious case of negligence and concealment by the school. File a written complaint to the SHO and DCP seeking FIR under Sections 75 JJ Act, 337, and 201 IPC. If police refuse, move 156(3) CrPC before Magistrate. Also, inform the Child Welfare Committee and Education Department to ensure action and preservation of CCTV footage.

The incident as narrated reflects serious negligence and breach of duty of care on part of the school authorities. Consuming diesel within school premises and the school’s failure to immediately inform parents amounts to gross misconduct and criminal negligence. You should file a written complaint to the SHO of the concerned police station, and if the police refuse to register an FIR, approach the higher authorities such as the DCP/Commissioner or file a private complaint before the Magistrate under Section 156(3) CrPC. You may seek FIR registration under Sections 284 (negligent conduct with poisonous substance), 337/338 (causing hurt by act endangering life), and 201 IPC for suppression of information. The school management can also be held liable under civil law for damages due to deficiency in service and breach of safety obligations. Immediately send a written notice to the school and request preservation of CCTV footage of the relevant date and time. If the footage is not secured, the same can be mentioned in your complaint as deliberate destruction of evidence.

You have the right to seek registration of an FIR under sections pertaining to negligence, endangering life of a child, and criminal breach of trust by public/educational authorities. If police are not registering the FIR, a written complaint can be filed before the Superintendent of Police under Section 154(3) CrPC or directly before the Judicial Magistrate under Section 156(3) CrPC. I can assist you in preparing the complaint, pursuing registration of FIR, and filing necessary applications before the court to ensure justice and compensation for your child’s trauma.

If the police officials are not responding positively then you should file an application before the court under section 175(3) BNSS to register a FIR against the school authorities for such a negligent act. For more legal assistance I am just a call away.
