It is to inform that a criminal case under prevention of corruption under section 13(1) (b) was registered on my father in sep 2019,on allegations of Possesing disproportionate assets. He was released on bail in nov 2019 . The ACB officials seized all the property and bank accounts and validated the disproportionate assets around 1 crore. Recently my father(A.O) died in may 2021 due to covid-19.He remained under suspension till then. Till now no chargesheet has been filed or no notice has been given. The case is still under investigation and till now no chargesheet has been filed . What is the legal position of this case further and and how to get seized assets released to legal heirs.

Since the accused is not alive, the prosecution will close the case as abated. they can't file chargesheet against a person who is no more. unless filing chargesheet the seized properties can't be confiscated by the state. but there is a prosedure to get release the seized properties from the hands of the authority if you claim with proper proofs as to origin of the seized properties.
