498a FIR Registered and Compromise Done At Police Station

Hi....FIR registered in Aug 2020 and compromise done in dec 2020 at police station....wife has given affidavit on stamp paper signed by notary. Stated that dont want to take legal action...will take mutual divorce...ow 3 months gone...I dont know anything what happened to my FIR...how to check it has been cancelled or not...can FIR cancelled at police station?

Hi ,it is advisable to get in touch with the concerned investigation officer ..Yes ,the police has the power to cancel the FIR ..The cancellation report has to be obtained from the investigation officer ..It is advisable to get it done before second motion of the mutual divorce petition....

complaint and FIR are two different aspects, as per the information you provided here, I think your wife had given a Complaint against you in the police station then it was compromised by the written document/affidavit then only it was compromised. Once an FIR was lodged it cannot be compromised at police station, it can only be quashed through high court. for more detailed discussion you can contact me for the same. Thank you.

You can file an application to the Illaqa Magistrate Concerned to know about the status of the FIR or you can seek the status by sending an RTI application mentioning the complete details of the FIR to the concerned police station Thanks
