Trademark Registration for setting up a new business

I am going to start a new business. I need to register a trademark for my business. My Business partner has his own company but I am not the part of that company. Is it possible that I can register trademark on my name by using his company name with his legal permission ?

the question itself is not clear please please make it clear that your partner has already registered Trademark in the name of his company and if you want to use the same name for your new company if yes you will not be able to register TM with the same name of the company
