Copyright of the business plan without registering a firm

If your idea is in written format or you have prepared it in some form or the other which can be copied, stolen or translated into another language or form then you may apply for the copyright in against the same. Otherwise till the time it is in the form of an idea you can't claim IPR rights over the same.
In Indian law it is only the transcripts, written subjects, prepared items in someway or the other which can be protected under copyright.
As far as trademark is concerned, it is given only for the logo and the tagline based on which company or an organization gets its identity and does its business.

You can certainly protect your plan under your name and once the company is registered you may assign or sale the registered idea to the company in return of consideration.

Under the Indian Copyright Law you cannot protect an idea/format/scheme etc., unless it is expressed in writing or in any other form.

However you can further discuss your business idea to ascertain if the same can be protected under any other form of intellectual property.

Idea alone cannot be registered under copyright Act.You can register the trademark under your individual name,transfer it to the firm later.Business ideas cannot be registered as Patents.If you can explain your exact issue then may be we can help.

Although in India there is no provision for getting a business idea registered as Intellectual Property, as Indian legal system does not recognize Business Idea as Intellectual property of any individual.
