Copyright issue regarding board casting in my YouTube Channel

Respected Lawyer, My name is Basanti Ghosh and I am from India, I owner of a YouTube Channel. I want to make animation video and also to read books from the books of a world renowned public figure rajnesh ji also know as Osho ji. But recently I made a video and broadcast it in public domain but there is a copy-right strike from the Copy-rights holders. So my question is how can legally I make animation from his books or it is not at all possible ? THANK YOU

Since you have received copyright strike, it means someone who claims to be a copyright owner or an agent authorized to act on behalf of owner, had sent You Tube administrator, a complete and valid legal request for the removal of your video as it amounts to copyright infringement. You Tube will take down your upload to comply with copyright law. Now there are three ways to resolve a copyright strike:

1. Wait for it to expire: Copyright strikes expire after 90 days, as long as you complete Copyright School. (https://support.google.com/youtube/answer/2802032)
2. Get a retraction: You can contact the person who claimed your video and ask them to retract their claim of copyright infringement. Click to link https://support.google.com/youtube/answer/57955?hl=en for sending and receiving private messages.
3. Submit a counter notification: If your video was mistakenly removed because it was misidentified as infringing, or qualifies as a potential fair use, you may wish to submit a counter notification by using our web form which is accessible via the Copyright Notices section of your account. However please note that when you submit a counter notice You Tube will forward it to the claimant who may use this information to file a lawsuit against you within 10 working days of the receipt of your counter notice, in order to keep the content from being restored to YouTube. (https://support.google.com/youtube/answer/2807684) This is a lengthy process once lawsuit is filed which you cost you both stress and monetary loss.

The best recourse I see in your situation is to contact the person who claimed your URL upload and ask them to retract their claim of copyright infringement. If he agrees to retract, both of you will be in a win-win situation as you will be spared from being sued from a legal battle. He wins as you are promoting the work of the author, wherein your audience will be both adults and children. You can also make an offer that the royalty so earned will go to the trust of Osho and that your objective are not commercial but for awareness and keeping the work of Osho alive through your URL upload. I guess if you are reasons are genuine the person may think of retracting their claim of copyright infringement.

Before sending a request for retraction, do a thorough research of the person who claimed your URL upload of copyright infringement as there is high chances, OIF is sending false copyright claim notices to youtube or facebook or other social network media even though there is a strong rulings against OIF.

For over past 15 years OIF threatened and shut down hundreds of Osho websites with Osho trademark notices and falsely removed by misusing DMCA notices to any Osho named / related websites. Finally in 2009 the US Patent and Trademark Ruling put an end to such illegal threats and exposed their initial applications as fraud against the US Trademark Office.

OSHO never assigned any copyrights nor left any last and final will for his copyrights to anyone; all OSHO books and spiritual talks are available freely on public domains given compassionately as his gift to humanity and for seekers of truth. There is no document known where OSHO assigns His copyrights to anyone else. International treaties on copyrights only apply when a copyright actually exists. Original books are available worldwide freely on the internet on many sites such as www.oshoworld.com, www.satrakshita.be
