Clutch Failure in Honda City at 6000 km, Warrant denied

19-Aug-2025 (In Consumer Court Law)
Need advice: My car has run only 6000 km in 2 years. Just after service at the authorized center, clutch failed within 60 km (12 km driven by service staff). Dealer claims “burn marks” = misuse of driver , asking full replacement cost, saying clutch not in warranty. But I believe it’s due to service misadjustment/defect, not my driving. Can I demand warranty cover or go to consumer court? What evidence should I keep?

You should first send a detailed legal notice to the dealer/manufacturer demanding free replacement/repair under warranty, citing clutch failure soon after service. Keep job card, service bill, photos, expert opinion. If they deny, you can approach consumer court for deficiency in service.

Yes, You can file a case in district consumer dispute redressal commission and claim for free replacement refund of cost of paid, compensation for harassment and the legal expenses. The strong evidence is your low running failure immediately after service and proof of negligence. The evidence you should keep is the job card and a bill delivery auto meter reading breakdown auto meter reading mechanic report export opinion photos videos communication records
