Who is the legal guardian of a married woman? Is the husband the legal guardian of his wife?

25-Jul-2024 (In Civil Law)
Can we list the husband's name as the legal guardian on a passport application, or could it lead to issues such as rejection? Who is considered the legal guardian of a married woman, and what are the consequences if this is not mentioned on the passport?

No, a husband is not automatically considered the legal guardian of his wife. In Indian law, both spouses are legal adults with independent rights. Guardianship typically applies to minors or individuals who are mentally incapacitated, and even then, a formal legal process is required to appoint a guardian. A husband may have responsibilities toward his wife, but that does not make him her legal guardian.
