Hello, In the present case, it is advisable to file a writ petition before the Hon’ble High Court, seeking issuance of a writ of mandamus on the same grounds. The said petition should specifically plead the relief sought and demonstrate that the respondent authority has failed to perform a statutory duty, thereby justifying the invocation of the writ jurisdiction of the Hon’ble Court.

As per your facts, you had uploaded the Central EWS Certificate instead of the State EWS Certificate at the time of online application to HPSC, though both certificates were issued on the same date and you produced the correct State EWS Certificate during document verification. This clearly appears to be a bona fide clerical error and not a case of misrepresentation or fraud. Under Article 226 of the Constitution of India, you have rightly filed a Civil Writ Petition (CWP) challenging the rejection, as the authorities are bound to consider substantial compliance when the eligibility condition stands fulfilled. Courts have repeatedly held that procedural or technical lapses should not defeat genuine entitlement — refer to Section 21, General Clauses Act, 1897 (power to correct clerical mistakes) and judgments where late submission of valid EWS/SC/ST certificates was condoned. Your case is legally strong since you held a valid State EWS Certificate as on the cutoff date and produced it before final selection. The rejection appears arbitrary and violative of Articles 14 and 16 of the Constitution. Relief is likely in your favour.
