Spit AC outdoor unit of Neighbor heating my room

29-Aug-2024 (In Civil Law)
My Neighbor installed Split AC and its outdoor unit is facing my house. It is at 15 feet distance from my door. It is heating my room and I am unable to sleep in my house. I have asked him to remove this outdoor unit and asked him to place any other place. But He denied for it. Do I have any legal option? What options legally I have to remove his outdoor unit of Air Condition

if it is at a distance of 15 feet distance from your door then you do not have a legal recourse to remove the AC unit as such. If you want to pursue legally then nuisance is the only recourse which you can take under the law of torts and for that the case will continue for upto 5-6 years and during that period your health will have negative impact. it is better that you speak to your neighbour about the same and describe him thenproblem

It's advisable for you to first of all rather than going legally you should serve them a legal notice and in that notice you can write either stop all these harassment or face legal action which will be at your own risk. After that if they fails to give you a satisfactory reply then you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction.
