Society members harassing my dad for being chairman
08-Oct-2025 (In Civil Law)
Society elected him as chairman 15 years ago even though my mom is the flat owner. They don’t reside in that flat, it’s given on rent. My mom had given my dad the power of attorney. The place is in talks for redevelopment. The deed conveyance has been done. Society members are calling it void as my dad can’t be the chairman as he isn’t the flat owner and calling him a fraudster. He is unwell and they society members are harassing my mom. Society says they didn’t know my dad wasn’t a flat owner.
The fact that your father’s election was never challenged for over a decade and that the conveyance deed and other acts of the society during his tenure were accepted, further strengthens his position under the principle of estoppel members cannot now claim ignorance after so many years. The society’s present allegations appear motivated by the redevelopment discussions, where control over the managing committee becomes significant. Your mother, as the actual member, may issue a written notice to the Managing Committee objecting to the defamation, harassment, and wrongful labeling of your father as a fraudster.
