Sec 351 demolition of shop notice issued by bmc.plz help me

Can my shop still be demolished
In case of shops the datum line is 01.04.1962. You need to show that the shop existed prior to that. First and foremost you must make an application to court for stay on the notice. This law is very draconian. The BMC will not stop unless you show that shop existed in structure since before 01.04.1962. Also, the BMC itself does not have old records. The catch here that BMC uses - the Assessment is for entire building and this does not show the existence of the shop. Also, make your landlord a party to the case proceedings. Ask your landlord to help you with old record. There is slight chance that landlord may be having old records.
