Sir.,Good morning i have submitted original house documents to court and i have gone for appeal,i need my original documents for house repair loan but where as lawyer says that once the documents as gone for appeal from lower court only after final of the case in the appeal court you will get the document,only lower court has powers so you wait.but my building is in danger what to do kindly advice me. more than one year case is running and document is in court. Thanking you in anticipation
Hi your advocate is right to some extent. However if there is so much urgency and need of the original documents in the right interests, you can file an IA praying for return of documents with valid reasons. Its left to the discretion of the court to pass a favourable order to your request.
